Lake Conservation & Permits

Wetland Mitigation- What is it?

Wetland mitigation was adopted by the state of Wisconsin in 2002. The Wisconsin DNR permitting process, under NR 103, requires every effort be made to avoid wetlands on site. If wetlands cannot be avoided then the impact to wetlands must be minimized. Minimization includes includes narrowing or moving a road, putting in a retaining wall, and/or moving structures to impact the least amount of wetland. Mitigation allows some flexibility in the permitting process, and in certain situations where wetlands would be impacted, an applicant for a wetland fill permit can include a proposal to mitigate the wetland fill by restoring wetlands to compensate for those destroyed. The DNR has developed Guidelines for Mitigation, and have many criteria for approving a mitigation plan.

Mitigation is expensive, and takes time to design, permit and construct. There are financial and legal guarantees that must be put in place to ensure that the work is done. The sites must be monitored for up to 5 years to make sure the restoration was successful. Wetlands that are restored as mitigation must have 100 foot wide upland buffers.
